ODDITY:- Rivers Govt denies plans to scuttle Obio/akpor judgement

LEGISREPORTS NG – Rivers State Government says it has no plans to arrest the judgement of the Obio/Akpor case pending before a State High Court.The State Attorney General Worgu Boms said this following claims by the Peoples Democratic Party (PDP) in the state that the government has mobilized judiciary staff union to go on strike inorder to scuttle the judgement.

Worgu Boms told newsmen in Port Harcourt that the matter is no longer at the state high court as the case file has been transferred and heard in Appeal Court in Port Harcourt.

He also reminded the people that the Obio/Akpor matter cannot run concurrently in two courts.”We have the records of appeal and we transmitted them to the court of Appeal and that was what enabled the court of Appeal to sit yesterday and after taking arguments from Counsels adjourned ruling to Thursday,  by the simple act of compiling and transmission of the records to Court of Appeal, the law has long been settled, the court below from which the appeal arose no longer has jurisdiction in the matter, there can be no concurrent proceedings from the High Court and the Court of Appeal in the same matter” he said.It would be recalled that the PDP in Rivers State said it has uncovered plans by the State to mobilize judiciary staff to embark on strike to scuttle the judgement.
